These Terms of Service ("Terms") govern your access to and use of the website located at tirepig.com (the "Site"), including any content, features, products, and services offered through the Site, operated by Tire Pig, Inc., a Delaware corporation ("Tire Pig," "we," "our," or "us"). Please read these Terms carefully before using the Site.

    BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE.

    1. Acceptance of Terms

    These Terms constitute a legally binding agreement between you and Tire Pig. Your use of the Site — including simply browsing — constitutes your acceptance of these Terms and our Privacy Policy, which is incorporated herein by reference. We may update these Terms at any time; continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The most current version will always be available at tirepig.com/terms.

    2. Eligibility

    You must be at least 18 years of age and legally capable of entering into binding contracts to use the Site or purchase products. By using the Site, you represent and warrant that you meet these requirements. If you are accessing the Site on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.

    3. Account Registration

    Certain features of the Site, including the Piggy Back Club membership program, require you to create an account. You agree to provide accurate, current, and complete information during registration and to update that information as necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at info@tirepig.com if you suspect any unauthorized use of your account. Tire Pig is not liable for any loss or damage arising from your failure to safeguard your account credentials.

    4. Products, Pricing, and Order Acceptance

    All product descriptions, images, specifications, and pricing on the Site are provided for informational purposes and are subject to change without notice. We make reasonable efforts to display product information accurately, but we do not warrant that descriptions, images, specifications, or prices are accurate, complete, current, or error-free. In the event of a pricing error, Tire Pig reserves the right to cancel any order placed at the incorrect price and to notify you of the error prior to fulfillment.

    Your placement of an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, including after an order confirmation has been sent. An order is not accepted until we have confirmed shipment. Tire Pig reserves the right to limit quantities, refuse service, and cancel orders, including orders that appear to be placed for resale or by automated means.

    5. Piggy Back Club Membership

    The Piggy Back Club is a paid membership program available in tiers (including Essential and Premium) that provides members with benefits including but not limited to pricing discounts, road hazard credits, access to exclusive content, and early product releases. Membership fees are billed in advance on an annual basis. New memberships and renewals are subject to a 30-day money-back guarantee as described in our Return Policy. After the 30-day period, fees are non-refundable except as required by applicable law. We reserve the right to modify membership benefits, tier structures, and pricing upon notice to members. Continued membership following such notice constitutes acceptance of the modified terms. Membership is non-transferable.

    6. Pig-Intelligence AI Recommendation Tool

    The Site may offer an AI-powered tire recommendation feature ("Pig-Intelligence") designed to help you identify tire options based on your vehicle, driving habits, and preferences. Pig-Intelligence recommendations are provided as a convenience and informational tool only — they do not constitute professional advice. You are solely responsible for verifying that any tire you purchase is appropriate for your vehicle, usage, and applicable legal requirements. Tire Pig disclaims all liability for decisions made in reliance on Pig-Intelligence outputs.

    7. Intellectual Property

    All content on the Site — including text, graphics, logos, images, audio clips, data compilations, product descriptions, and software — is the property of Tire Pig, Inc. or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. The "Tire Pig" name, logo, and all related marks are trademarks of Tire Pig, Inc.

    You may access and use the Site for personal, non-commercial purposes only. You may not: (a) reproduce, distribute, display, or transmit any content without our prior written consent; (b) use any data mining, scraping, crawling, or automated extraction tools on the Site; (c) frame or mirror the Site on any other server or device; or (d) use the Site in any manner that could harm, disable, or impair it or interfere with other users' access.

    8. User-Generated Content

    If you submit reviews, comments, photos, or other content to the Site ("User Content"), you grant Tire Pig a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, adapt, publish, translate, and distribute that content in connection with our business. You represent that you own or have the necessary rights to submit the User Content and that it does not violate any third-party rights or applicable law. Tire Pig reserves the right to remove any User Content at its sole discretion.

    9. DMCA / Copyright Policy

    Tire Pig respects intellectual property rights. If you believe that content on the Site infringes your copyright, please send a written notice to our designated DMCA agent at info@tirepig.com containing: (a) a description of the copyrighted work; (b) the URL or location of the allegedly infringing content; (c) your contact information; (d) a statement of good faith belief; and (e) your physical or electronic signature. Repeat infringers may have their access to the Site terminated.

    10. Third-Party Links and Partners

    The Site may contain links to third-party websites, including financing partners (such as Shopify Payments, Affirm, Klarna, PayPal, and Katapult), installer networks, and other service providers. These links are provided for convenience only. Tire Pig does not control, endorse, or assume responsibility for the content or practices of any third-party website. Your interactions with third-party services are governed by their respective terms and privacy policies. We encourage you to review those terms before transacting with any third party.

    11. Installation Services and Installer Network

    Tire Pig may facilitate connections between customers and independent mobile tire installation operators (each an "Installer") through the Site or affiliated platforms. These Installers are independent contractors, not employees or agents of Tire Pig. Tire Pig does not control the manner or means by which Installers perform services, and we do not guarantee the quality, safety, legality, or timeliness of any installation services. Any disputes arising from installation services should be directed to the applicable Installer. To the maximum extent permitted by law, Tire Pig is not liable for any acts or omissions of any Installer.

    12. Klarna Financing — Right to Withdraw and Cancellation Policy

    The following terms apply exclusively to purchases of installation services completed using Klarna as a payment method. For product purchases (tires, wheels, and accessories) made via other payment methods, please refer to our standard Return Policy at tirepig.com/return-policy.

    Right to Withdraw: If you purchase an installation service using Klarna and wish to cancel, you have the right to withdraw from the transaction within 14 days of the date of purchase, provided the service has not yet commenced. To exercise this right, you must notify us in writing within that 14-day window by contacting info@tirepig.com with your order number and a clear statement of your intent to cancel.

    No Refund Once Service Has Started: If any portion of the installation service has commenced, the right to withdraw no longer applies and no refund will be issued for any services already rendered. You are responsible for the full cost of any service that has begun.

    Refund Timeline for Klarna Purchases: Approved refunds on Klarna-financed service cancellations will be processed and returned to Klarna within 14 business days of our receipt of your valid written cancellation notice. Klarna will then adjust your payment plan in accordance with their own terms and conditions.

    No Rebooking Fees, Credits, or Exchanges via Klarna: For installation services purchased through Klarna, we are unable to offer rebooking fees, store credit, or product/service exchanges in lieu of a monetary refund. Eligible cancellations within the 14-day window will result in a full monetary refund only, returned to Klarna within the timeline stated above.

    13. Disclaimer of Warranties

    THE SITE, ALL CONTENT, PRODUCTS, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TIRE PIG DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

    14. Limitation of Liability

    TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIRE PIG, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY PRODUCT OR SERVICE PURCHASED THROUGH THE SITE, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    IN ALL EVENTS, TIRE PIG'S AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO TIRE PIG IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

    15. Indemnification

    You agree to indemnify, defend, and hold harmless Tire Pig, Inc. and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property rights; or (d) any User Content you submit.

    16. Binding Arbitration and Class Action Waiver

    PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

    Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product or service purchased through the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. You agree that any arbitration will be conducted on an individual basis and not as a class action, collective action, or representative proceeding. YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

    Notwithstanding the above, either party may bring an individual claim in small claims court for disputes within that court's jurisdiction. This arbitration agreement does not apply to claims for injunctive or equitable relief to protect intellectual property rights.

    17. Governing Law and Jurisdiction

    These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. For any matter not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

    18. Force Majeure

    Tire Pig shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor disputes, supply chain disruptions, carrier failures, or government actions.

    19. Severability

    If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

    20. Entire Agreement

    These Terms, together with our Privacy Policy and any applicable order confirmation, constitute the entire agreement between you and Tire Pig with respect to the subject matter hereof and supersede all prior understandings, agreements, or representations.
